These Terms of Service ("Terms") govern your use of the website sankrantiaustralia.com.au and any services offered by Sankranti Australia ("we", "us", "our"), including catering, dine-in, and takeaway services across our Melbourne locations. By accessing this website or submitting an enquiry, you agree to be bound by these Terms. If you do not agree, please do not use the website or our services.
1. About us
Sankranti Australia operates restaurants across Melbourne CBD specialising in South Indian, North Indian, Indo-Chinese, and fusion cuisine, with four locations as of the date of this policy: Sankranti Docklands, Sankranti Telstra, Sankranti Galleria, and Sankranti Paramount. Dine-in, takeaway, and catering services are provided subject to availability.
2. Website use
You may use this website for lawful personal and non-commercial purposes. You agree not to:
- Use the website in any way that breaches any applicable Australian, state, or international law.
- Attempt to gain unauthorised access to any part of the website, the admin panel, or any server or database.
- Upload, post, or transmit any material that is unlawful, defamatory, harassing, or infringes a third party’s rights.
- Interfere with or disrupt the website or servers, or introduce viruses or harmful code.
- Use automated scraping, crawling, or data-mining tools without our express written permission.
3. Catering enquiries and quotes
Submitting a catering enquiry through the contact form or by email does not constitute a binding order or contract. A quote provided by us is an invitation to treat. A binding contract is formed only when:
- We send you a written quote (email) specifying price, date, menu, number of guests, and delivery details; AND
- You confirm acceptance of that quote in writing (email reply is sufficient); AND
- You pay any deposit we request by the due date.
Quotes are valid for 14 days from the date we send them unless otherwise stated. Menus, pricing, and availability are subject to change until the booking is confirmed.
4. Catering deposit, payment, and cancellation
Unless we agree otherwise in writing:
- A non-refundable deposit of 25% of the total quote is required to secure a catering booking.
- The balance is payable no later than 48 hours before the event.
- Cancellations made more than 7 days before the event: deposit forfeited, no further charge.
- Cancellations made 48 hours to 7 days before the event: 50% of the total becomes payable.
- Cancellations made within 48 hours of the event: 100% of the total becomes payable.
- Reschedules made more than 7 days out and within 60 days of the original date: deposit transferred, no penalty.
5. Dietary requirements and allergens
We prepare food in kitchens where nuts, dairy, gluten, shellfish, eggs, and soy are routinely handled. Despite reasonable precautions, we cannot guarantee any dish is free of trace allergens. It is your responsibility to:
- Advise us of any allergies or dietary requirements at the time of ordering.
- Confirm allergen information with our staff before consuming any item.
- Make any final decision about the suitability of our food for your needs.
Our liability for any allergic reaction is limited to the fullest extent permitted by law where you have not disclosed a known allergy in advance.
6. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer rights you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other rights that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, including that they are of acceptable quality and fit for their intended purpose.
If we supply a service that is not a "major failure" under the Australian Consumer Law, we may elect to re-supply the service or refund the portion that was not properly supplied, at our discretion. For major failures, you are entitled to a refund.
7. Website content and intellectual property
All content on this website — text, images, logos, menu designs, photography, and the Sankranti Australia name and brand — is owned by or licensed to us and is protected by Australian copyright and trademark law. You may view and print pages for personal, non-commercial use, but you must not reproduce, modify, distribute, or use any content for commercial purposes without our written permission.
8. Third-party links and services
This website may link to third-party sites and services including Google Maps, Facebook, Instagram, and delivery platforms (Uber Eats, DoorDash, Menulog, Deliveroo). We do not control those sites and we are not responsible for their content, privacy practices, or availability. Your use of any third-party site is governed by that site's own terms and privacy policy.
9. Limitation of liability
To the maximum extent permitted by Australian law and subject to Section 6 (Australian Consumer Law):
- We provide the website on an "as is" and "as available" basis without warranties of any kind.
- We do not guarantee the website will be uninterrupted, error-free, or free from viruses.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or our services.
- Our total liability for any claim arising from your use of the website is limited to AUD $100 or the amount you paid us in the previous 12 months, whichever is greater.
10. Indemnity
You agree to indemnify us and hold us harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or your unlawful use of the website.
11. Governing law and jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the courts of appeal from them. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force.

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.
